Martin Luther King Parade Foundation Scholarship Gala Raffle

Official Rules

The Martin Luther King Parade Foundation, Inc., in Tampa, Fla., in accordance with the requirements set forth in Section 849.0935 of the Florida Statutes, is the organization sponsoring this raffle. The Martin Luther King Parade Foundation’s principal place of business is 5508 N. 50th Street, Suite 28, Tampa, Fla., 33612. The mission of the Raffle is to support the charitable efforts of the various programs and services of the Martin Luther King, Jr. Parade Foundation.

No contribution or donation is necessary to enter to win. Void outside of the promotion area and where prohibited by law. All disputes will be resolved solely by binding arbitration and entrants waive the ability to bring claims in a class action format. The Raffle is offered only within the State of Florida (“the Promotion Area”). Void outside the Promotion Area and where prohibited.

Eligibility

U.S. residents 18 years or older and present in the Promotion Area at the time of entry are eligible to enter. Employees of Martin Luther King Parade Foundation, Inc. and their family members and household residents, are not eligible to enter. Void where prohibited.

How to Enter

To enter the Raffle, an eligible entrant must acquire a ticket during the draw period from the Dr. Martin Luther King Parade Foundation, Inc. (https://mlkjrparade.com). Each ticket will be unique to the donation and those numbers shall be used to determine the winner of the Raffle. Each ticket is valid only for the Drawing corresponding to the current draw and Entry Period during which such Raffle Ticket was obtained. Non-winning Raffle Tickets are void and will not carry over to any subsequent raffles or drawings. Raffle Ticket donations are not tax deductible, and no refunds will be made, except as otherwise determined by the Dr. Martin Luther King Parade Foundation, Inc. in its sole discretion.

Raffle tickets will be available starting Friday, Tuesday, December 18th, 2023 at approximately 5:00 PM EST and ending on Friday, January 5, 2024 at approximately 8:00 PM EST. The winners will be selected by a drawing conducted randomly by raffle software and the prizes will be awarded on Friday, January 5, 2024, around 9:00 p.m. The drawing will be held at the Hilton Tampa Downtown, 211 N. Tampa Street, Tampa, Fla. The more tickets you enter, the more chances you have to win.

There are two (2) ways to obtain Raffle tickets:

  1. Online Sales: You may obtain Raffle tickets online at the Raffle page (http:// mlkjrparade.org) by following the instructions to complete the transaction and provide any required information;
  2. No contribution or purchase necessary: You may obtain a Raffle ticket without a donation by sending an postcard requesting an entry to:

    with the following required information: Name, Address, Phone, and Email. If information is not provided, void where prohibited.

The suggested minimum contribution for the Raffle tickets is based upon the prize offered. Raffle ticket donations are not tax deductible and making a donation will not increase your chances of winning.

IMPORTANT: MESSAGE AND/OR DATA RATES MAY APPLY TO THE USE OF MOBILE PHONES/DEVICES TO PARTICIPATE IN THE RAFFLE. WIRELESS SERVICE MAY NOT BE AVAILABLE IN ALL AREAS. EACH WIRELESS CARRIER’S DATA RATE PLAN MAY VARY, AND YOU SHOULD CONTACT YOUR WIRELESS CARRIER FOR INFORMATION ON DATA RATE PLANS AND CHARGES RELATING TO YOUR PARTICIPATION IN THIS RAFFLE.

All Raffle Ticket sales and requests must include a valid daytime phone number or email address if requested for the entrant and the entrant remains solely responsible for notifying the Martin Luther KingParade Foundation of changes in his/her/their contact information.

If you participate in the Raffle online, you agree that the information that you provide in connection with the Raffle may be used by the Martin Luther King Parade Foundation in accordance with the Privacy Policy (detailed below).

Determining the Winner

To become an Official Winner: (1) must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in the organization’s sole judgment. If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular Potential Winner or is unable to be confirmed the holder of the Winning Ticket, then that Potential Winner will be deemed disqualified. The organization shall use the following rules to determine the identity of any Potential Winner and of the Official Winner of each Prize: the organization shall conclusively presume that the person who is in possession of the Winning Ticket is the lawful owner of that Ticket and that Ticket’s Winning Number, and the organization shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which that person came into possession of such Winning Ticket.

The winning tickets will be determined by a random draw utilizing a random number generation application. All tickets, each containing a unique ticket number will be emailed to ticket purchasers by the Martin Luther King Parade Foundation. A physical ticket will not be mailed out for this draw.

Winners and the prizes will be awarded on Friday, January 5, 2024, around 9:00 p.m. The drawing will be held at the Hilton Tampa Downtown, 211 N. Tampa Street, Tampa, Fla. The winner will be notified by live announcement, phone, and email. Winners need not be present to win. Winners attending the gala may pick up the items after the announcement of winners. Others may contact the Foundation at 813-803-8060 to arrange item pick up at the Foundation office.  The winner has 60 days to claim their prize. Draw results will appear under the “Winners” tab found on the main raffle page. Entrants do not need to be present to win. Forfeited Prizes may be retained by the Dr. Martin Luther King, Jr. Parade Foundation for charitable use.

Upon compliance with these Official Rules, the official winner shall be entitled to receive one of the prize items listed below.

    • Tampa Bay Black Heritage Festival Weekend (January 13 – 14, 2024)
  • 3rd Prize – Suggested ticket donation $20 each
    • Dance Theater of Harlem at the Straz (January 23, 2024)
  • 4th Prize – Suggested ticket donation $20 each
    • Dinner for two at Lepley’s Kitchen & Lounge (Seminole Heights)
  • 5th Prize – Suggested ticket donation $20 each
    • Outback Steakhouse Gift Basket
  • 6th Prize – Suggested ticket donation $20 each
    • Coopers Hawk Wine Basket
  • 7th Prize – Suggested ticket donation $20 each
    • Five $20 Outback Steakhouse Gift Cards

General Terms: All prizes are non-transferable and cannot be exchanged for cash. There will be no minimum nor maximum of raffle tickets sold. A payment for a raffle ticket does not qualify as a charitable contribution and is not tax deductible. The raffle is not preconditioned on a certain number of tickets being sold.  Winners are responsible for any additional expenses not explicitly included in the prize descriptions.  Upon compliance with these Official Rules, the official winners shall be entitled to receive one (1) of the above-listed prizes. Potential Winners must provide the organization with all tax identification information required by federal, state, or local law and, where applicable, provide the organization with payment for any required withholding taxes due prior to that Potential Winners’ receipt of the Prize. If the Prize was valued at more than $600, the Raffle Winners will receive on or before January 31st of the immediately following calendar year a W-2G federal income tax form setting forth the amount of the Prize and the Withholding Amount (if any).

The winner(s) assumes sole responsibility for all expenses and incidental costs associated with accepting or claiming the prize not expressly included in the prize description above, including without limitation, all federal, state, and/or local taxes, including sales, use, and income taxes (if any), any transportation to claim the prize, fees and/or other items.

Winners may be required to complete an affidavit of eligibility if you are chosen as the winner of the raffle. By returning your raffle tickets, you agree that your name will be included in the list of winners published on our website and social media, if you are selected as a winner of the raffle. Late entries received will be processed as general donations.

The winner(s) will be issued any Internal Revenue Service (“IRS”) tax forms or other required documentation and/or reporting forms for the Actual Retail Value (ARV) of the prize awarded if required. The winner is solely and exclusively responsible for all state, federal, or local income taxes that may result from his/her/their acceptance of the prize. The Dr. Martin Luther King, Jr. Parade Foundation is required by law to withhold and remit to the IRS on the winner’s behalf an amount equal to twenty-four percent (24%) of his/her/their prize awarded (the “Withholding Amount”) if the value of the prize exceeds $5,000 and the winner is a citizen or resident alien of the United States with a Social Security number (different rules as promulgated by the IRS apply for nonresident aliens and for resident aliens and citizens of the United States who do not have a Social Security number) or as otherwise required by law. Failure to comply with any of the rules on this page may result in disqualification.

Additional terms

Eligibility for Alcohol Prize: Participants must be 21 years of age or older to win the Coopers Hawk gift basket. Proof of age will be required to claim this prize. The contest reserves the right to substitute this prize with an alternative of equal value for winners under the age of 21. Music Festival Tickets: Winners of the music festival tickets are solely responsible for all transportation to and from the festival location. The prize includes only the entry tickets to the event. Restaurant Visits: Restaurant vouchers or tickets are subject to the terms and conditions of the respective establishments. Transportation to and from the restaurant is not included in the prize. Travel Prizes: Travel prizes are limited to the specifics stated in the raffle description (e.g., accommodation, guided tours). Winners are responsible for their own transportation to and from the travel destination, including any airfare unless specifically mentioned as part of the prize.

Privacy Policy

The Official Winner agrees that acceptance of the Prize grants to the organization and the organization’s designees and affiliates, the right to print, publish, broadcast, and use worldwide and on the Internet, in any media now known or hereafter developed at any time or times, the Official Winner’s name, portrait, picture, voice, likeness, biographical information, and Prize information for any purpose, including but not limited to in advertisements, trade and promotional purposes, publicity, and other communications without additional compensation, in perpetuity, without notice, review, or approval, except where prohibited by law.

Disputes

Except where prohibited by law, by participating in the Raffle, you expressly agree that (a) all disputes and causes of action arising out of or connected with the Raffle or the prize shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules in Hillsborough County, Florida; and (b) judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or other participants, shall be governed by Florida law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Florida.

By entering, accepting a prize and/or otherwise participating in the Raffle, you expressly agree that any legal proceedings not subject to arbitration and arising out of or relating in any way to this Raffle or these Official Rules shall be brought only in the federal or state courts located in Hillsborough County, Florida, and you consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
